On Saturday 7th December, leaders of grassroots movements from across the Global South came together for the first time at COP25 to collectively discuss the growing international climate justice movement in response to the global climate crisis. The session was a powerful discussion about resilience, repression and accountability in using the law to address the highly disruptive and damaging consequences of climate change for communities.

The Huaraz Case in its fourth year
Further delay in taking evidence worrying in the light of hazardous situation on site

The plaintiff Saúl Luciano Lliuya and his family need a lot of patience in this worldwide-perceived lawsuit. After the court's decision to enter into the evidentiary stage, it had taken a long time until the official experts for the taking of evidence could be determined. This was partly due to objections by RWE‘s lawyers, which were rejected by the court.
Now even more time is needed to realize a recent court-appointed on-site visit to Peru/Huaraz.

RWE AG), Roxana Baldrich (Policy Advisor at Germanwatch) and Christoph Bals (Policy Director at Germanwatch) about the lawsuit brought by Saul Luciano Lliuya against RWE in relation to its contribution to climate change (the Huaraz case).

In November 2015, Saúl Luciano Lliuya, a Peruvian farmer living in Huaraz in Peru, filed a lawsuit in Germany against RWE, Germany’s largest electricity producer. Mr Lliuya claims that his house in the village of Huaraz is at imminent risk of being damaged or destroyed due to an outburst flood from a glacial lake, caused by the melting of glaciers linked to climate change.

In the trial of the Peruvian mountain guide Saúl Luciano Lliuya against the energy company RWE before the Higher Regional Court of Hamm, the court has now announced that it will select the experts for the taking of evidence itself.

The decision announced today by the Higher Regional Court Hamm (Germany) to enter into the evidentiary stage in the case of Saúl Luciano Lliuya against the german utility RWE is of great legal relevance. It is the first time that a court acknowledged that a private company is in principal responsible for its share in causing climate damages. This applies if concrete damages or risks for private persons or their property can partly be assigned to the activities of the relevant company.

Higher Regional Court Hamm: Large emitters can be held legally responsible for climate change impacts

The 5th civil chamber of the Higher District Court Hamm (Germany) wrote legal history today. It gave a clear statement that large emitters like RWE are liable for supporting people in poorer countries affected by climate change. The climate-suit of Saul Luciano Lliuya will therefore enter into the next phase. On 30th November, the court is expected to formally announce its decision to enter into the evidentiary phase. At that point, it will be necessary to provide sufficient evidence in this specific case to prove that RWE must provide a financial contribution as Luciano Lliuya has demanded. The court's argument is of great significance for many people who suffer from climate change impacts.
